Please read these terms carefully before using TaskCentro. They govern your access to and use of our platform.

Acceptance of Terms

  1. By accessing or using the TaskCentro platform (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use immediately. TaskCentro is operated by TaskCentro Services Limited (the "Company"), a company limited by shares, having its registered office at The United Church of Zambia Synod Building, Plot No. 8, Ground Floor, Northern Wing, Mosi O Tunya Road, Woodlands, Lusaka.
  2. By registering as a User on the Platform and agreeing to these Terms and Conditions of use, you hereby duly consent and agree, as if the same consent and agreement were in writing, to your personal data being processed by TaskCentro.
  3. You are hereby duly informed of your right to withdraw your consent.
Continued use of the Platform after any update to these Terms constitutes your acceptance of the revised Terms.

Platform Overview

TaskCentro is a web and Application based service marketplace connecting clients with verified service providers across Zambia. The Platform facilitates job posting, bidding, contract creation, payment processing, and communication between parties.

User Accounts

You must create/register an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. By signing up you agree and covenant to provide accurate and up-to-date information during registration and at all times.

Client and Freelancer Obligations

Clients agree to post accurate job descriptions, honour agreed contract terms, and make timely payments for completed work.

Freelancers agree to provide services as described, meet agreed deadlines, and maintain professional conduct at all times.

Both parties agree not to circumvent the Platform by arranging payments or communications outside of TaskCentro. Violations may result in permanent account suspension.

All transactions on the Platform are governed by the TaskCentro Refund Policy, available at taskcentro.com/refund-policy. Both parties are expected to understand its terms before engaging in any contract.

User-Generated Content and Representations
By uploading, submitting, or transmitting any content (including but not limited to photos, videos, documents, and text) through the Service, you represent and warrant that:

  1. You are the sole creator and owner of the content, or you have obtained all necessary licences, rights, consents, and permissions from the rightful owners to use and authorise TaskCentro to use the content on the platform.
  2. The content does not infringe upon the copyright, trademark, privacy, publicity, or other intellectual property rights of any third party.
  3. You have obtained explicit consent from any identifiable individuals appearing in your photos or videos to upload their likeness to the Service.

You agree to indemnify and hold TaskCentro harmless from any claims, damages, or expenses arising out of your breach of these warranties.

Payments and Commission

All payments are processed through the Platform's integrated payment gateway provided by Cellulant Zambia Limited also known as Tingg. TaskCentro charges a 10% commission on all transactions. The commission is deducted automatically before funds are released to the Freelancer. All amounts are displayed in Zambian Kwacha (ZMW) unless stated otherwise.

TaskCentro reserves the right to change the applicable commission rate at its discretion as a result of, but not limited to, any operational, economic, financial, or regulatory changes.

  • Clients must confirm payment on their registered mobile device when prompted.
  • Payments are only released to Freelancers after the Client has approved the performed work as submitted by a Freelancer.

Contracts

Contracts are binding agreements between Clients and Freelancers. A contract may be edited (including fee adjustments) by the Client before payment is made. Once payment is made, contract terms are final and cannot be changed without mutual agreement by the parties.

Disputes

TaskCentro provides a dispute resolution mechanism. In the event of a dispute, both parties agree to engage in good faith negotiations and mediation through the Platform's dispute process. TaskCentro reserves the right to make final decisions in disputes and the decision of TaskCentro shall be final and binding on the parties.

Prohibited Conduct

Users must not engage in fraud, harassment, impersonation, or any illegal activity on the Platform. Posting false or misleading information, spam, or offensive content is strictly prohibited. Violations may result in the immediate account suspension and possible reporting to the law enforcement agencies for possible prosecution.

Users must not access, collect, misuse, disclose, or share the personal data of other users obtained through the Platform without lawful authority. This includes, but is not limited to, using contact details, identity information, or any other personal data of Clients or Freelancers for purposes outside the Platform or in any manner inconsistent with these Terms. Such conduct constitutes a violation of applicable data protection law and may result in immediate account suspension, civil liability, or referral to the relevant authorities.

Intellectual Property

All content, trademarks, and software on the Platform are the property of TaskCentro. Users retain ownership of the work they produce, but grant TaskCentro a licence to display such work on the Platform for promotional/marketing purposes.

Limitation of Liability

TaskCentro acts as a marketplace and is not liable for the quality, legality, or completion of services between Clients and Freelancers.

TaskCentro, its agents, servants, employees, or Officers shall not be held liable for any damages, loss or harm arising from the provision of services by Freelancers, the use of the Platform, or any breach including any direct, indirect, or consequential losses.

Tax Compliance

Providers are solely responsible for complying with all applicable tax laws, including the accurate reporting of income and remittance of all applicable taxes. TaskCentro may, at its sole discretion, request evidence of tax compliance from Providers and may suspend accounts for failure to comply. TaskCentro may collect and remit taxes on behalf of Providers where legally required.

Freelancer Responsibilities

  • Deliver services as described and in a manner consistent with professional standards.
  • Maintain all required licences, certifications, and insurance as may be required by applicable laws.
  • Ensure that all services are conducted safely and in compliance with applicable laws and regulations.

Failure to comply with these responsibilities may result in suspension or permanent removal from the Platform.

Environmental or Sustainability

TaskCentro encourages environmentally sustainable practices among its users. We promote the use of eco-friendly materials, energy-efficient services, and responsible disposal of waste. Providers who demonstrate a commitment to sustainability may be highlighted within the platform as environmentally responsible service providers.

User Reviews and Public Content

Clients may leave reviews and ratings of Freelancers following the completion of services. Freelancers are categorically prohibited from manipulating, incentivising, or falsifying reviews. TaskCentro reserves the right to remove reviews or other content that violates these Terms, is fraudulent, abusive, or irrelevant.

Customer Support

TaskCentro offers dedicated customer support to address inquiries and resolve issues related to platform use, service bookings, and transactions. We aim to respond to all inquiries within 24 hours.

Fraud Prevention and Liability

TaskCentro employs robust fraud detection systems and reserves the right to suspend, investigate, or cancel any transaction deemed suspicious. Users must ensure that payment information is accurate and must not engage in any fraudulent activity. Any such violations will result in immediate suspension or termination.

TaskCentro provides a platform for connecting Clients and Freelancers but does not guarantee the quality, safety, or legality of the services provided by Freelancers. TaskCentro, its agents, servants, employees, or Officers shall not be held liable for any damages, loss or harm arising from the provision of services by Freelancers, for the use of the Platform, or any breach including any direct, indirect, or consequential losses.

Termination of Accounts

Voluntary Termination
Users may terminate their accounts at any time. Termination does not absolve Users from any obligations accrued prior to termination.
Involuntary Termination
TaskCentro reserves the right to suspend or terminate any User account for violation of these Terms or applicable laws.
Surviving Obligations
Provisions relating to confidentiality, liability, and payment obligations will survive termination of a User's account.

Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Changes to These Terms

TaskCentro reserves the right to update these Terms and Conditions from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes via Email or in-platform notification.

Data Breach Notification

TaskCentro is committed to operating in compliance with the Data Protection Act No. 3 of 2021 (the "Act"). In the event of a personal data breach affecting your information, TaskCentro will notify the Office of the Data Protection Commissioner within twenty-four (24) hours of becoming aware of the breach, in accordance with Section 49 of the Act.

Where the breach is likely to result in a risk to your rights or interests, TaskCentro will also notify you as soon as practicable, providing details of the nature of the breach, the categories of data affected, the likely consequences, and the steps being undertaken to remedy the breach. Notifications will be sent to the email address associated with your account. You are responsible for keeping your contact details current on the Platform.

Your Data Protection Rights

TaskCentro handles your personal data in accordance with the Data Protection Act No. 3 of 2021 (the "Act"). Under the Act, you have the following rights in relation to your personal data. To exercise any of these rights, please contact us at [email protected].

Right of Access
You may request confirmation of whether we hold personal data about you and obtain a copy of that data, including the purposes for which it is processed and the categories of third parties with whom it has been shared.
Right to Object
You have the right to object, at any time, to the processing of your personal data, including where your data is processed for direct marketing purposes. Where you object to processing for direct marketing, we will cease that processing immediately.
Right to Rectification
You may request that we correct any inaccurate or incomplete personal data we hold about you.
Right to Erasure
You may request deletion of your personal data where it is no longer necessary for the purposes for which it was collected, where you withdraw consent, or where it has been unlawfully processed. We may retain certain data where required to do so by law or to fulfil our legal obligations.
Right to Withdraw Consent
Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal. To withdraw consent, contact us at [email protected] or update your account settings.

Data Protection Complaints and Regulatory Compliance

If you believe that TaskCentro has not handled your personal data in accordance with the Data Protection Act No. 3 of 2021, you have the right to lodge a complaint directly with the Office of the Data Protection Commissioner of Zambia. We encourage you to contact us first at [email protected] so that we may seek to resolve your concern before you escalate to the regulator. You also have the right to appeal any decision of the Data Protection Commissioner to the High Court of Zambia within thirty (30) days of that decision.

TaskCentro is committed to full compliance with the Data Protection Act No. 3 of 2021, including any Code of Conduct issued by the Data Protection Commissioner that applies to data controllers.

Community Guidelines

Users must adhere to our Community Guidelines, which promote respectful, safe, and lawful interactions. Prohibited conduct includes but is not limited to harassment, abuse, fraud, and any form of discrimination. Users found in violation of these guidelines may face temporary suspension or permanent termination of their accounts. TaskCentro reserves the right to review, monitor, and remove content that breaches these guidelines.

Governing Law and Jurisdiction

These Terms shall be governed by the Laws of the Republic of Zambia. Any disputes arising out of these Terms shall be resolved through the Courts of Law in the Republic of Zambia. TaskCentro reserves the right to vary these terms as and when appropriate to do so.

Marketing and Promotion of Freelancer Profiles

By registering on the Platform, the Freelancer hereby consents and agrees that TaskCentro Services Limited shall be at liberty to use the Freelancer's personal data including but not limited to their name, job profile, skills, and photograph(s) for promotional and marketing purposes. This includes use on the TaskCentro platform and on TaskCentro's social media channels, without requiring further approval or authorisation from the Freelancer. Such use is solely for the purpose of promoting the Freelancer's profile and services to potential clients.

Works Contracted Outside the TaskCentro Platform

Any agreement to engage or perform work between a Client and a Freelancer outside the confines of the TaskCentro platform is entered into entirely at their own risk. TaskCentro takes no responsibility and shall not be held liable for any disputes, losses, damages, or claims arising from such arrangements.
